In Jharkhand, the blacksmith caste will remain OBC, the plea for inclusion in ST rejected in HC


It has been said in the petition that the Jharkhand government has separated the Lohar caste from the category of ST and included it in the OBC. Earlier the blacksmith caste was in ST. This decision of the government is in violation of the order of the Supreme Court.

In Jharkhand, the Lohar caste will be included in the category of OBC only. The plea to include him in ST has been rejected by the High Court. On Tuesday, the court of Justice Rajesh Shankar upheld the decision of the Jharkhand government in which the Lohar caste has been included in the OBC in August 2019 by excluding the ST category. With this order, the court dismissed the petition filed for inclusion of Lohar in ST.

What is the whole matter

Dashrath Prasad had filed a petition in this regard. It has been said in the petition that the Jharkhand government has separated the Lohar caste from the category of ST and included it in the OBC. Earlier the blacksmith caste was in ST. This decision of the government is in violation of the order of the Supreme Court. Additional Advocate General Ashutosh Anand appeared on behalf of the government.

Court argument

Told the court that the decision of the state government is absolutely correct. The Supreme Court had also held that Lohra and Lohar would be in the ST category. Due to being a blacksmith in Hindi, the said caste was given the status of ST category, which is not correct. The court, while accepting the submissions of the state government, dismissed the petitioner's petition. The court, in its order, accepted that the blacksmith caste would be considered as OBC category only.
